What kinds of things could pose a problem with a spouse visa petition?

Ineligibility for a Visa: Some conditions and activities might make the applicant ineligible for a visa, but there may be a waiver available (so speak to an attorney about that, and the processes involved).  Examples of ineligibility include:

  • Having HIV/AIDS
  • Drug trafficking
  • Overstaying a previous visa
  • Practicing Polygamy
  • Submitting fraudulent documents
